Consultations Booking Policies

1. Consultation Fee & Booking Confirmation

A R70 consultation fee (EFT only) is required to confirm your booking. Proof of payment must be sent before your appointment is secured.

2. Booking Timeframe

Appointments must be booked at least 3 working days in advance. Urgent bookings (within 48 hours) are available for an extra R50.

3. Rescheduling Policy

You may reschedule once for free if done 48 hours or more in advance.


Terms and Conditions

1. General Terms

AiDevs (Pty) Ltd provides software development, tech support, admin support, and related services.
- All work is performed according to the agreed service scope and quote.
- Prices exclude any third-party costs unless stated in writing.
- AiDevs reserves the right to refuse service where necessary, including but not limited to unethical requests, non-payment, or violation of these terms.
- These terms are governed by the laws of the Republic of South Africa.

2. Payments & Refunds

- Invoices are payable within 15 days of issue. Late payments incur 2% monthly interest.
- A 35% non-refundable deposit is required before work commences. Deposits are refunded only if AiDevs cancels the project.
- No work begins without written acceptance of the quote and deposit payment.

3. POPIA (Data Protection)

- By agreeing, you consent to AiDevs collecting, processing, and storing your personal information for business purposes.
- Data is stored securely and shared only when legally required (e.g., tax authorities, court orders).
- You may request access, correction, or deletion of your data via email.
- Data is retained for 5 years post-project completion unless legally required otherwise.

4. Client Responsibilities

- Clients must provide accurate, complete, and timely information.
- Delays in providing required materials may extend timelines and incur additional costs.
- Clients warrant that all provided content (logos, text, etc.) is legally owned/licensed and indemnify AiDevs against infringement claims.

5. Rewards Points Program

5.1. Eligibility: Open to all AiDevs clients. Participation constitutes agreement to these terms.
5.2. Earning Points: Points awarded for actions (e.g., referrals, social media engagement). AiDevs verifies eligibility before awarding points.
5.3. Points Value: 100 points = 10% discount on a single service (excludes third-party costs).
5.4. Redemption: Points redeemable at 100+, one-time use, non-transferable, no cash value.
5.5. Exclusions: Discounts apply only to qualifying services, not entire invoices.
5.6. Expiry: Points expire 12 months from earning date.
5.7. Changes: AiDevs may modify/discontinue the program without notice.
5.8. Fraud: Points revoked for abuse (e.g., fake accounts, manipulation).
5.9. Liability: AiDevs is not liable for losses related to the program.

6. Website & Marketing Usage

- AiDevs may display completed work in portfolios unless client opts out in writing.
- Client logos may be used for marketing unless a written opt-out is received.
- Opt-out requests must be made within 14 days of project completion.

7. Limitation of Liability

- AiDevs is not liable for indirect, incidental, or consequential damages.
- Direct damages are capped at the total fee paid for the affected service.
- Force Majeure: Not liable for delays/cancellations due to unforeseeable events (e.g., natural disasters, strikes).

8. Intellectual Property

- Pre-Existing IP: Each party retains ownership of their pre-existing materials.
- Deliverables: Ownership transfers to the client upon full payment.
- Licensing: If deliverables include AiDevs-owned tools/templates, client receives a non-exclusive, non-transferable license.
- Open-Source Components: Client acknowledges if third-party/open-source code is used.

9. Confidentiality

- Both parties agree to keep confidential information (business strategies, code, data) private.
- Confidentiality survives 3 years after contract termination.
- Exceptions: Legally required disclosures or publicly available information.

10. Dispute Resolution

- Negotiation: Parties must attempt good-faith negotiations for 30 days before escalation.
- Mediation/Arbitration: If unresolved, disputes go to mediation in Johannesburg (South African Arbitration Foundation rules).
- Litigation: If mediation fails, parties may pursue claims in South African courts.

11. Termination

- By Client: May terminate with 30 days' written notice; unpaid work is billed at hourly rates.
- By AiDevs: May terminate for non-payment, breach, or unethical requests.
- Survival Clause: Sections on IP, confidentiality, liability, and disputes survive termination.

12. Changes to Terms

- AiDevs may update terms at any time; changes are effective when posted on our website.
- Clients are notified via email or website notice. Continued use constitutes acceptance.
